Authorities say they took Fakih into custody at 2:15 a.m. Saturday and charged her with operating while impaired, reports CBS station WWJ.

Police say they released the beauty queen at about 4 p.m., but she sent out a contradictory tweet, writing, “Let’s clear things up now…. I’m NOT in Michigan and I’m NOT in jail! Wrong Fakih,” according to TMZ.

Since then, the tweet has been deleted.

“She is taking full responsibility,” Fakih’s lawyer, Doraid Elder tells the Detroit Free Press. “She wants to apologize to everybody she let down.”

The 26-year-old Fakih won the Miss USA Pageant in May 2010. Her reign ended June 19, 2011. She was the first Miss Michigan to win the title since 1993 and the first Arab American winner ever.

If convicted, she faces up to 93 days in jail, plus fines and court costs, and may be ordered to perform community service, according to the Detroit Free Press.
